1 Acceptance of Terms
By accessing or using the Bizutiful platform (available at bizriv.com and related subdomains), you ("Tenant" or "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the platform.
These Terms apply to all users, including business owners, administrators, and anyone granted access to a tenant account on the platform.
2 Beta Platform — No Guarantees of Stability
Bizutiful is currently provided as a beta product. This means:
- The platform is still under active development and testing. Bugs, outages, and unexpected behaviour may occur.
- Features may be added, modified, restricted, or removed at any time without prior notice.
- The current free access is offered during the beta phase only. Pricing tiers, feature limitations, and billing structures will be introduced and may change at any time, with or without notice.
- We do not guarantee continuous or uninterrupted access to any feature or the platform as a whole.
Your continued use of the platform after any changes are made constitutes your acceptance of those changes.
3 Pricing, Tiers, and Feature Availability
The platform is currently free of charge during the beta period. However:
- Bizutiful reserves the right to introduce paid tiers, usage limits, and feature restrictions at any time.
- Pricing, plan structures, and what is included in each tier may change with or without advance notice.
- Continued use of the platform after the introduction of paid tiers will constitute acceptance of the then-current pricing terms.
- We will make reasonable efforts to communicate significant pricing changes, but we are not obligated to do so under these Terms.
4 Limitation of Liability — Tools Only
Bizutiful provides software tools to help you manage and grow your business. We are a tooling provider only. We are not a business partner, advisor, or guarantor of any business outcome.
To the maximum extent permitted by applicable law:
- Bizutiful shall not be liable for any loss of profits, revenue, data, goodwill, or any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform.
- We are not responsible for any business decisions made based on data, reports, or insights generated by the platform.
- We are not liable for losses resulting from platform downtime, data errors, feature changes, or service interruptions.
- Your use of the platform is entirely at your own risk.
5 Tenant Responsibilities
As a Tenant using Bizutiful, you are solely responsible for:
- All content you upload, publish, store, or transmit through the platform, including but not limited to product listings, customer data, images, documents, and communications.
- Ensuring that any content you upload does not infringe upon the intellectual property rights, trademarks, or copyrights of any third party.
- Obtaining all necessary licences, permissions, and consents for any third-party content or materials you use within the platform.
- Complying with all applicable local, national, and international laws and regulations in connection with your use of the platform and your business operations.
- Any misuse of the platform, including but not limited to fraudulent activity, spam, illegal content, or harm to other users.
Bizutiful is not responsible for and expressly disclaims all liability arising from content submitted by Tenants. You agree to indemnify and hold harmless Bizutiful and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your content or your violation of these Terms.
6 Intellectual Property
The Bizutiful platform, including its design, code, branding, and documentation, is the intellectual property of bizriv.com and its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform solely for your business purposes in accordance with these Terms.
You retain ownership of all content you upload to the platform. By uploading content, you grant Bizutiful a limited licence to store and process that content solely for the purpose of delivering the service to you.
7 Prohibited Use
You agree not to use the platform to:
- Upload or distribute unlawful, harmful, defamatory, or infringing content.
- Attempt to gain unauthorised access to any part of the platform or another Tenant's data.
- Use the platform for any illegal or fraudulent purpose.
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the platform.
- Resell or sublicence access to the platform without prior written consent from Bizutiful.
8 Account Suspension and Termination
Bizutiful reserves the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or if it is necessary to protect the integrity of the platform or other users.
You may close your account at any time by contacting us. Upon termination, your access to the platform and its data will cease. We are not liable for any loss of data following account termination.
9 Privacy
Your use of the platform is also governed by our Privacy Policy. By agreeing to these Terms, you acknowledge that you have reviewed and agree to the Privacy Policy.
10 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which bizriv.com is registered, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
11 Changes to These Terms
We reserve the right to update or modify these Terms at any time. The most current version will always be available on this page. It is your responsibility to review these Terms periodically. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
